ORGANIC LAW OF EDUCATION
Chapter I Basic Provisions of the Law Subject
Article 1. Si proibisce l'impiego di figure o modi come fondazioni, associazioni civili, società mercantili, o qualunque altro meccanismo al fine di esercitare coercizione nel pagamento di quote superiori a quelle stabilite dall'organo rettore e ulteriori enti che regolano la materia.

Articolo 7. Lo Stato manterrà in qualunque circostanza il suo carattere laico in materia educativa, preservando la sua indipendenza rispetto a tutte le correnti e gli organismi religiosi. Le famiglie hanno il diritto e la responsabilità dell'educazione religiosa dei loro figlie e figlie d'accordo alle proprie convinzioni ed in conformità con la libertà religiosa e di culto, prevista dalla Costituzione della Repubblica.

Gli organi con competenze in materia d'educazione basica ed educazione universitaria, conconderanno opportunamente e diligentemente i trasferimenti e le equivalenze che avranno luogo, agli studenti e alle studentesse tra istituzioni venezuelane, salvo quanto previsto dalle leggi speciali.
Riconoscimento degli studi realizzati all'estero
Artcolo 48. Gli organi con competenza in materia d'educazione basica e d'educazione universitaria normeranno l'assegnazione di convalide o equivalenze degli studi realizzati in istituzioni straniere riconosciute, allo scopo che gli stessi abbiano validità nel territorio nazionale. La normativa prenderà in considerazione gli accordi legalmente sottoscritti dalla Repubblica Bolivariana del Venezuela.

Articolo 49. Per il sottosistema d'educazione basica l'anno scolastico avrà duecento giorni abili. QUARTA: Fino a quando non si promulghi la Legge Speciale che regolerà l'ingresso, l'esercizio, la promozione, la permanenza, il proseguimento e l'uscita dalla professione docente, in base ai principi costituzionali e alla presente Legge, si stabilisce che l'ingresso, la promozione e la permanenza degli educatori e delle educatrici nel Sistema Educativo risponderà ai criteri di valutazione integrale di merito accademico e disimpegno etico, sociale ed educativo, senza ingerenza di partito o di altra natura non accademica, e si ordina all'organo con competenza in materia d'educazione basica di stabilire un Regolamento Provvisorio d'Ingresso e Ascesa nella Docenza, nell'arco dei tre mesi seguenti la pubblicazione su Gazzetta Ufficiale della presente Legge.
QUINTA: Per ragioni di necessità comprovata nei differenti livelli e modalità del sottosistema d'educazione basica e nel frattempo che duri questa condizione ddi necessità, si potranno incorporare professionisti di aree distinte alla docenza con le stesse condizioni di lavoro dei professionisti e delle professioniste docenti. I requisiti, le condizioni ed il regime di servizio si stabiliranno in una normativa dettata a tal effetto dall'organo rettore in materia d'educazione basica.
DISPOSIZIONE OBBLIGATORIA
UNICA: Si deroga la Legge Organica dell'Educazione pubblicata su Gazzetta Ufficiale della Repubblica del Venezuela N° 2.635 Straordinario, in data 28 luglio del 1980. Il suo Regolamento Generale ed il Regolamento dell'Esercizio della Professione Docente restano vigenti in ciò che non contraddica la presente Legge.
DISPOSIZIONE FINALE
UNICA: La presente Legge entrerà in vigore a partire dalla sua pubblicazione Official Gazette of the Bolivarian Republic of Venezuela.
